Article VIII, Section 24-a of the state constitution provides that the legislature may not impose a tax on the net incomes of individuals, and Section 1(c) extends the legislature's power to tax incomes only to corporations other than municipal. TX local individual income tax authority No Texas local government levies an income, wage or payroll tax for tax years 2024 and 2025. One statute, Transportation Code §451.401, lets a metropolitan rapid transit authority — Houston, San Antonio, Austin, Corpus Christi — "impose any kind of tax except an ad valorem property tax." For a tax on income, wages or payroll, its board must first adopt a tax code and voters must approve the tax in an election (§§451.402–451.403). The same goes for a district such an authority creates (§451.707(d)); San Antonio has the only one. None has; each levies only a sales tax. Tax years 2024 and 2025; reviewed September 19, 2026. Not levied Texas Constitution, Article XI, Sections 4 and 5 (local taxing power exists only as authorized by law); Texas Transportation Code, Chapter 451, Sections 451.401 to 451.403 and 451.707; Texas Comptroller, transit sales and use tax; U.S. Census Bureau, 2022 Census of Governments finance datasets (individual unit file)
